Terms & Conditions
(1) CANCELLATIONS
Bodhi Khaya reserves the right to cancel any booking forthwith and without liability on its part in the event of any damage or destruction of the venue by fire, water, or any other cause, any shortage of labour or food supplies, strikes, lockouts or industrial unrest, or any cause beyond our control which shall prevent Bodhi Khaya from performing its obligations in connection with any bookings. Bodhi Khaya will issue a 100% refund or accommodation credit (valid for 12 months from date of issue and subject to accommodation availability) for all cancellations initiated by us.
* Please note that the facilitation fee is separate from our costs,
so in the event of a full credit given, we will need to withhold the facilitation fee portion as it will be paid to the facilitator.
This is applicable in the event of cancellations 14 days or less prior to the start of the retreat.
(1.1) CANCELLATION, CREDIT AND REFUND POLICY - RETREAT GUESTS AND PARTICIPANTS
Cancellations 72 hour before the start of the retreat - no refund or accommodation credit but booking transferable to a friend.
Cancellations between 14 days - 72 hours before the start of the retreat - 50% refund or 100% accommodation credit minus R200 admin fee
Cancellations more than 14 days before the start of the retreat - full refund or accommodation credit minus R200 administration fee.
(1.2) INDEMNITY & WARRANTIES
The Participant and Guest shall hold blameless and indemnify Bodhi Khaya, its teachers, facilitators, community, directors/members, officers, employees, agents, independent contractors, representatives, subsidiaries, affiliates, controlling or holding companies and insurers past and present (“The Indemnified Parties”) who shall not be liable or responsible for any personal injury, harm, death, loss of support or any other damages of any nature whatsoever whether arising from negligence or any other cause whatsoever.
(1.3) INDEMNITY & WARRANTIES
The Teacher shall hold blameless and indemnify Bodhi Khaya its teachers, facilitators, community, directors, members, officers, employees, agents, independent contractors, representatives, subsidiaries, affiliates, controlling or holding companies and insurers past and present (“The Indemnified Parties”) who shall not be liable or responsible for any personal injury, harm, death, loss of support or any other damages of any nature whatsoever in respect of either the Teacher or the Participant, whether arising from negligence or any other cause whatsoever.
The Teacher, Facilitator, or Organiser of a Retreat or Event, warrants that s/he has the necessary event and personal liability Insurance.
(2) DEFINITIONS
Teacher(s) shall mean any person hosting or facilitating a retreat or workshop or organizing or leading a person/s for an event at Bodhi Khaya Nature Retreat PTY (LTD) (hereafter Bodhi Khaya).
Participant(s) shall mean any person attending a retreat or workshop or event at Bodhi Khaya.
Guest(s) shall mean any independent person booking a personal retreat at Bodhi Khaya.
Client(s) shall mean Teachers, Participants, Organizers, Guests and any other person engaging the services offered by Bodhi Khaya.
Days shall mean calendar days and months shall mean calendar months.
(3) BUSINESS
Bodhi Khaya is a business in the hospitality, wellness and education industry and offers a retreat venue to Teachers, Participants, Organizers, and Guests. Bodhi Khaya also hosts its own retreats and personal stays
(4) DELIVERY POLICY
Subject to availability and receipt of payment, requests will be processed within 10 days and delivery confirmed by way of a Registration ID.
(5) CLIENT PRIVACY POLICY
Bodhi Khaya shall take all reasonable steps to protect the personal information of Clients. For the purpose of this clause, "personal information" shall be defined as detailed in the Promotion of Access to Information Act 2 of 2000 (PAIA). (6) PAYMENT OPTIONS ACCEPTED
Payment may be made via Visa, MasterCard, Diners or American Express Cards or by bank transfer into the Bodhi Khaya bank account (bank details provided on request).
(7) INTEREST
Interest will be charged at prime, as charged by First National Bank at the applicable time, plus 2% per month or part thereof for any amounts outstanding.
(8.1) CARD ACQUIRING AND SECURITY
Card transactions will be acquired for Bodhi Khaya via PayGate (Pty) Ltd who are the approved payment gateway for all South African Acquiring Banks. DPO PayGate uses the strictest form of encryption, namely Secure Socket Layer 3 (SSL3) and no Card details are stored on the website. Users may go to www.paygate.co.za to view their security certificate and security policy.
(8.2) CLIENT DETAILS SEPARATE FROM CARD DETAILS
Client details will be stored by Bodhi Khaya separately from card details which are entered by the client on DPO PayGate’s secure site. For more detail on DPO PayGate refer to www.paygate.co.za.
(9) MERCHANT OUTLET COUNTRY AND TRANSACTION CURRENCY
The merchant outlet country at the time of presenting payment options to the cardholder is South Africa. Transaction currency is South African Rand (ZAR).
(10) RESPONSIBILITY
Bodhi Khaya takes responsibility for all aspects relating to the transaction including sale of goods and services sold on this website, customer service and support, dispute resolution and delivery of goods.
(11) COUNTRY OF DOMICILE
This agreement is governed by the laws of South Africa and Bodhi Khaya chooses as its domicilium citandi et executandi for all purposes under this agreement, whether in respect of court process, notice, or other documents or communication of whatsoever nature:

(12) VARIATION
Bodhi Khaya may, in its sole discretion, change this agreement or any part thereof at any time without providing notice thereof.
(13) COMPANY INFORMATION
This website is run by Bodhi Khaya Nature Retreat PTY (LTD) based in South Africa trading and with registration number 2006/110546/23 and directed by Georgina Hamilton Stevens and Matt Stevens.
